BREAKING NEWS – Menopause symptoms can be considered a disability, as confirmed in guidance issued by The Equality and Human Rights Commission (EHRC). Amongst other things, this will trigger an employer’s duty to make all reasonable adjustments for menopausal workers. These can include providing rest areas, flexible hours of work and a relaxation to normal uniform policies (to allow menopausal workers to wear clothes which are cooler for them). A failure to make reasonable adjustments could amount to unlawful disability discrimination, as could the taking of disciplinary action against a worker for menopause-related absences from work. Of those surveyed, the EHRC has said that a staggering one in 10 women who worked during their menopause had been forced to leave their job due to their menopause symptoms. This too could lead to litigation. It is extremely likely now that we will see substantially more claims being brought in this area.
