Calling a male colleague bald as an insult can now constitute sexual harassment in the workplace (but not unlawful age discrimination)

An Employment Tribunal panel (comprised of three men) has just ruled in the case before it that there was “a connection” between the word “bald” and the “protected characteristic of sex”.  The term “bald” was used as an insult.  This was classed as a form of sexual harassment.  The Claimant consequently won his claims for unfair dismissal, wrongful dismissal and sexual harassment.  He lost a further claim for age discrimination after the Tribunal found that the insult could not constitute a reference to his age as you basically can’t define the age at which a particular man goes bald.  The Claimant’s compensation will be determined at a later date at a costs hearing.
